在讨论和评价孔、孟思想之际应该将相关言说进行认真辨析的基础上努力把握其原本含义,然后将其置入具体语境以及历史背景中加以理解,否则容易产生“隔阂肤廓之论”。基于这样的原则和方法对孔孟所谓“亲亲相隐”思想进行分析之后不难发现,孔子所谓“父为子隐、子为父隐”系在实践基础上并着眼于从根本上解决问题而总结出来的思想。正因为如此,它与孟子有关舜“窃负而逃”的言说一样,很可能并不违背春秋战国的相关制度,故而不存在所谓徇情枉法的问题。
