从1981年加拿大最高法院采用合同A/B方法以来,这种分析方法就成了加拿大法院解决投标过程中的法律纠纷的分析框架。本文概述了30年来加拿大在此领域的发展、进化,并将加拿大与英国对待此问题所采用的不同方法进行了比较。作者认为,尽管加拿大的方法存在一些缺点,这种合同A/B分析框架本身的灵活性很适用于解决投标中的法律纠纷。
Since the contractual A / B method was adopted by the Supreme Court of Canada in 1981, this method of analysis has become the analytical framework for Canadian courts to resolve legal disputes in the bidding process. This article outlines Canada’s evolution in this area over the past 30 years and compares the different approaches taken by Canada and the UK to this issue. The author argues that despite the shortcomings of the Canadian approach, the flexibility of the contractual A / B analysis framework itself is well suited to resolve legal disputes in tenders.
