关于饮酒驾车与醉酒驾车的法律规定:一、《道路交通安全法》规定酒后驾驶机动车,记6分,罚500元,暂扣驾驶证1—3个月;酒后驾驶营运机动车,记12分,罚500元,暂扣驾驶证3个月;醉酒驾驶机动车,记12分,罚2000元,暂扣驾驶证3—6个月,拘留15天以下;酒醉酒驾驶营运机动车,记12分,罚2000元,暂扣驾驶证6个月,拘留15天以下;一年内有醉酒驾驶机动车被处罚两次以上的,吊销机动车驾驶证,五年内不得驾驶营运机动车。第九十一条规定:饮酒后驾驶机动车的,处暂扣六个月机动车驾驶证,并处1000元以上2000元
