经济性裁员制度是指用人单位为了改善其自身生产经营状况,而采取的一种一次性辞退部分劳动者的手段。通过对裁判文书网上的案例进行分析,并与域外各国和地区的法律规定相比较,文章认为我国以《劳动合同法》第41条为基础建立的经济性裁员制度存在着一系列的问题,并就这些问题提出进一步完善该制度的一些建议。
Economic redundancy system refers to the employer in order to improve their own production and management of the state, and taken a one-time dismissal of part of the workers means. By analyzing the online cases of referees’ documents and comparing with the laws and regulations of other countries and regions outside the region, the article holds that there are a series of problems in our economic layoff system based on Article 41 of the Labor Contract Law Put forward some suggestions on these issues to further improve the system.
