著作权集体管理组织以其行政化与垄断性广受诟病,我国著作权法《修改草案送审稿》将著作权集体管理制度延伸适用于非会员作品,更引发了相关权利人的一片质疑。本文试分析非会员利益保护动因,并结合我国著作权法相关规定,探究延伸性集体管理下相关权利人担忧的原因。最后,根据我国集体管理组织的运行现状,并结合域外实践经验,提出我国保护非会员权利的相关建议,以期更好实现著作权延伸性集体管理的制度价值。
Collective copyright management organizations have been widely criticized for their administrative and monopolistic nature. Our “Copy Draft Amendment Draft” of the Copyright Law extends the copyright collective management system to non-member works and raises questions among the right holders. This article tries to analyze the motivation of non-member benefits protection, and in conjunction with the relevant provisions of our copyright law to explore the reasons for the extension of collective management under the concerns of the relevant rights holders. Finally, according to the current running status of CMOs in China and the practical experience abroad, this paper puts forward some suggestions on how to protect the rights of non-members in China so as to better realize the institutional value of collective management of copyright.
