王先生在沿海一家专门经营国外产品的中型公司上班,因受到金融危机影响,该公司濒临倒闭。不得已之下,2008年10月底,老板告诉全体职工决定自即日起放长假,时间不定,短则几个月,长则也许一两年,而对于工资、补偿问题只字未提。近来,受美国次贷危机引发的金融危机影响,我国少数中小型企业面临经营困难,像王先生这样合法权益遭受侵害的现象屡有发生。为了规避风险,这些企业有的通过裁员来缓解支付压力,有的采取放长假的方式来渡过难关,而有的则在无奈之下只好关门倒闭。这种情况下,企业往往可能以“金融危机”为借口忽视职工的一些基本权益。而职工也往往因为不懂法不知道自己应当享有哪些权益,致使一些合法权益遭受侵害。其实,金融危机之下,职工可享有的权益仍然有很多,大致体现在以下几大方面:
Mr Wang runs a mid-sized company on the coast specializing in foreign products. Due to the financial crisis, Mr. Wang is on the verge of bankruptcy. As a last resort, at the end of October 2008, the boss told all staff and workers to decide to take long holidays with immediate effect. The time ranged from a few months to as long as a year or two. However, there was no mention of wage and compensation issues. Recently, as a result of the financial crisis triggered by the U.S. subprime mortgage crisis, a handful of SMEs in our country are facing operating difficulties. Such legitimate rights and interests as Mr. Wang have infringed on. In order to evade risks, some of these enterprises alleviate the pressure of payment through layoffs, and some adopt a long-term fare to weather the storm while others have no other choice but to close down. Under such circumstances, the enterprises may often ignore some basic rights and interests of their employees under the pretext of “financial crisis ”. However, employees often do not understand the law because they do not know what rights they should enjoy, resulting in some legitimate rights and interests were infringed. In fact, under the financial crisis, there are still many rights and interests enjoyed by workers and staff, which are broadly reflected in the following aspects:
