元代在继承前代经验的基础上,结合少数民族政权的特点及当时的社会实践,建立了中国古代法律史上独具特色的监察法律制度。本文从元代监察法律制度的指导思想、监察法律制度的建构以及体现于其中的创新与变革等诸方面论述元代监察法制,得出结论:元代监察法律制度的确立标志着中国古代监察法律制度的真正成熟。
On the basis of inheriting the experience of its predecessors, the Yuan Dynasty established a unique legal system of supervision in the history of ancient Chinese law, combining with the characteristics of the ethnic minority government and the social practice at that time. This article elaborates the supervisory legal system in the Yuan Dynasty from the aspects of the guiding ideology of the supervisory legal system in the Yuan Dynasty, the construction of the legal system and the innovation and change embodied in it, and concludes that the establishment of the supervisory legal system in the Yuan Dynasty symbolizes the ancient Chinese supervisory law The real maturity of the system.
