亚历山大·汉密尔顿说:“如果人是天使,就不需要政府了;如让天使来统治人,也就无须对政府采取内外部的控制。在组织一个人统治人的政府时,最大的困难在于使政府能管好被统治者的同时,管理好政府自身。”国家权力无论掌握在谁的手里,如果不受到制约,都有可能侵犯了公民权利。另一方面,国家权力是由人来行使的,人的认识又是有限度的,只能认识相对真理,而不能一步达到真理。因此,不管哪一种制度的国家,客观上都不可避免会发生侵犯人权的事情,正因如此,才有了《国家赔偿法》。
