基于党的群众路线理念指导下产生的体现公民参与侦查的相关法律制度以及实践中的创新做法,在侦查实践中落实状况极不理想。以监督侦查活动为价值目标的公民参与侦查始终处于边缘化状态,我国的人民监督员制度也已经显现出公众对侦查程序合法性问题开展监督的发展态势。公民参与侦查并发挥协助侦查与监督侦查双重职能,在当下具有相当的必要性,至少可以作为过渡性的辅助机制以实现侦查权的合理控制。但公民参与侦查并监督侦查的方式只能是事后监督,作用的对象为较为固定的相应侦查场所或者相对终局性的侦查结果。
Under the guidance of the concept of the mass line of the Party, the relevant legal systems that reflect the participation of citizens in investigation and the innovative practices in practice are extremely unsatisfactory in the practice of investigation. The investigation of citizen participation in monitoring the value of reconnaissance activities has always been marginalized. The system of people’s supervisors in our country has also shown the development trend of public supervision over the legitimacy of investigation procedures. Citizens’ participation in the investigation and giving play to the dual functions of assisting in the investigation and supervision and investigation have the considerable necessity at the moment, at least as a transitional auxiliary mechanism to realize the reasonable control of the investigation power. However, the means by which citizens participate in the investigation and supervise the investigation can only be post-supervision, and the objects of the investigation are the relatively fixed corresponding investigation sites or the relatively final investigation results.
