耕地抛荒已经对我国的粮食安全构成威胁,面对即使承包经营耕地的单位或者个人连续二年弃耕抛荒的,原发包单位也不敢终止承包合同,收回发包的耕地的尴尬现实,笔者建议建立具有强制效力的被抛荒耕地托管制度予以应对,并就该制度的法律依据、事实依据、强制托管机构的建立及其经费保障、被抛荒耕地强制托管的方式与优先权保障、被强制托管的抛荒耕地的利用、被抛荒耕地强制托管的解除等方面进行了较深入的思考。
