我国宪法经由数次修正已经日趋完善,但是随着市场经济的发展和社会生活的变化,宪法作用不可避免的会体现出诸多局限性。目前,国内面临着住房全面短缺的难题,其中社会保障房的建设更是问题的重中之重。住房问题关系到国计民生,而宪法则是国家的根本大法,规定国家生活和社会生活中最基本的问题。公民的住房权是保障公民住宅权实现的基本方式。本文从公民住房权保障与实现的角度来阐述宪法的局限性,试图以有效途径减少宪法作用的局限性,增强宪法条文的实效性,更好地落实公民住房权的保障问题。
The amendment of our country’s constitution has been perfected by several times. However, with the development of market economy and the change of social life, the role of the constitution will inevitably bring about many limitations. At present, the domestic face with the overall shortage of housing problems, including social security housing construction is the most important issue. The housing issue is related to national economy and the people’s livelihood. The constitution, on the other hand, is the fundamental law of the country, which stipulates the most basic problems in the life and social life of the country. Citizens ’right to housing is the basic way to guarantee the realization of the right of citizens’ residence. This article expounds the limitation of the constitution from the perspective of the protection and realization of the citizen’s right to housing, tries to reduce the limitation of the role of the constitution by an effective way, enhance the effectiveness of the constitutional provisions, and better implement the guarantee of the citizen’s right to housing.
