先取证、后裁决是行政机关行政执法中的一项基本原则,根据此原则行政机关向法院提交的证据必须是其作出被诉行政行为所依据的相关材料。现有法律赋予了原告或第三人提交新证据的权利,但缺乏新证据对被诉行政行为合法性影响的规定。本文拟从现有法律对行政诉讼当事人提供证据的相关规定着手,分析现有规定对我国行政诉讼审判造成的影响,并在此基础之上对行政诉讼新证据进行划分,结合行政审判的目的赋予不同种类的证据相应的效力。
The first evidence collection and post-judgment are the basic principles in the administrative law enforcement of the administrative organ. According to this principle, the evidence submitted by the administrative organ to the court must be relevant materials on which the administrative act of the party to be prosecuted is based. The existing law gives the plaintiff or the third party the right to submit new evidence, but lacks the new evidence that affects the legality of the administrative act being sued. This article intends to start from the relevant provisions of the existing law on providing evidence to administrative litigation parties, analyzes the impact of the existing provisions on the trial of administrative litigation in our country, and on the basis of which the new evidence of administrative litigation is divided, Different kinds of evidence of the corresponding effect.
