基本医疗卫生服务的人权标准包括经济标准、伦理标准和文化标准三个方面,源于联合国经济、社会和文化权利委员会《第14号一般性意见(2000年)》第12条,在中国大陆尚未引起应有的重视。这导致基于基本医疗卫生服务人权标准的医院治理现代化程度不高,使医疗领域存在许多亟需良法善治的问题。应当加强基本医疗卫生立法,确保政府和(公立)医院当局在法治的框架下建立和落实基本医疗卫生服务的人权标准,加快(公立)医院治理现代化步伐。围绕这些方面,文章提出了具体的意见和建议。
Human rights standards for basic health services include economic standards, ethical standards and cultural standards, which derive from Article 12 of the UN General Comment No. 14 (2000) of the Committee on Economic, Social and Cultural Rights in mainland China Caused due attention. This has led to the low level of modernization of hospital administration based on human rights standards for basic medical and health services, which poses many problems in the medical field that urgently require good governance. Basic medical and health legislation should be strengthened to ensure that the government and (public) hospital authorities establish and implement human rights standards for basic medical and health services within the framework of the rule of law so as to speed up (public) hospital administration modernization. Around these aspects, the article made specific comments and suggestions.
