在我國專利制度設置中,對發明專利和實用新型、外觀設計專利採用了不同的審查方式:只對發明專利進行實質審查, 對實用新型和外觀設計專利則僅僅進行形式審查,致使後兩種專利權的穩定性相對較弱,較易受到挑戰。例如,在涉及實用新型專利或外觀設計專利侵權的訴訟中,被告常常會對原告專利權人據以起訴的專利向國家知識產權局專利複審委員會提出專利無效宣告請求,遇到這種情况,法庭將根據最高人民法院《關於審理專利糾紛案件適用法律問題的若干規定》以及《民事訴訟法》第136條的相關規定考慮是否中止訴訟。
