随着中国改革开放的深入和市场经济的发展,为适应国内统一大市场、世界经济全球化和中国加入世界贸易组织的需要,我国通过修改相关法律来提高知识产权的保护水平。正是在上述背景下,我国于2001年修改了《商标法》,随后又颁布了一系列配套的法规、规章、司法解释,共同来加强对商标专用权的保护。因为驰名商标是商标中更具价值的知识产权,更容易受到他人的仿冒侵害,所以新《商标法》及其配套的法规、规章、司法解释加强了对驰名商标的保护力度。可以说我国已经建立起较为完善的驰名商标法律保护制度,保护水平已与国际接轨。但是无论在理论上还是在实践中,仍然存在一些有待解决的问题。本文就其中驰名商标的保护措施中存在的问题试论一二。
With the deepening of China’s reform and opening up and the development of the market economy, in order to meet the needs of a unified domestic market, the globalization of the world economy and China’s accession to the World Trade Organization, China has amended the relevant laws to improve the protection of intellectual property. It is against this background that our country amended the Trademark Law in 2001 and subsequently promulgated a series of supporting laws, regulations and judicial interpretations to jointly strengthen the protection of the exclusive right to use trademarks. Because well-known trademarks are more valuable intellectual property in trademarks and are more likely to be falsified by others, the new Trademark Law and its accompanying laws, regulations and judicial interpretations strengthen the protection of well-known trademarks. It can be said that our country has established a relatively complete well-known trademark legal protection system and the level of protection has been in line with international standards. However, there are still some problems to be solved both in theory and in practice. This article discusses the existing problems in the well-known trademark protection measures.
