所谓司法解释,是指最高人民法院、最高人民检察院作出的在审判、检察工作中具体应用法律问题的解释。据统计,截至目前,全国人大及常委会的立法共有243部,而司法解释有多达4200件。司法解释过多过滥问题凸显。以新刑事诉讼法为例,修改后是290条、3.5万字左右,而最高人民法院就刑诉法出台的司法解释共有548条、7万字左右。
The so-called judicial interpretation, refers to the Supreme People’s Court, the Supreme People’s Procuratorate made in the trial, procuratorial work specific application of legal interpretation. According to statistics, up to now, there are altogether 243 laws of the NPC and the Standing Committee, and as many as 4,200 judicial interpretations. Judicial interpretation of excessive problems highlighted. Taking the new code of criminal procedure as an example, after the amendment is 290 and about 35,000 words, the Supreme People’s Court issued a total of 548 judicial interpretations on the Criminal Procedure Law and about 70,000 words.
