在界定重复发表和一稿多发两个概念的基础上,运用合同法和知识产权法理论分析,认为违法的应是重复发表,而一稿多发则是著作权人的合法权利。报刊社若要对作者的一稿多发的权利滥用加以有效规制,需采取一系列组合式防范机制。
On the basis of defining the two concepts of repeated publication and multiple manuscripts, the article analyzes the contract law and the theory of intellectual property law, that illegal should be published repeatedly, and that multiple manuscripts are the legal rights of the copyright owner. If newspapers and periodicals want to effectively regulate the author’s abusive abuse of manuscripts, a series of combined prevention mechanisms should be adopted.
