从著名案例前微软全球副总裁李开复跳槽Google,到戴尔公司高层管理人员跳槽联想公司、万明坚带领TCL旧部20多人“转会”长虹,高管“高价”跳槽成为人力资源论题的焦点。“高价跳槽”风潮般遍及IT、电讯、金融、餐饮旅游等各个行业。鉴于人力资源的合理流动和商业秘密保护,我国在制度设计上欲两全其美,期待已提交讨论的《中华人民共和国商业秘密法(草案)》能给予我们一个优化的答案。任何制度的设计和选择都是利益博弈的结果,在寻找答案的过程中,笔者鉴于“高价跳槽”涉及的多方利益,力图分析其背后的利益博弈。

We hope that the “Law of the People’s Republic of China on Trade Secrets (Draft)” that has been submitted for discussion can give us an optimized answer. The design and choice of any system are the result of the game of interest. In the process of finding the answer, the author tries to analyze the interest game behind the multi-stakeholder interests involved in “high-priced job-hopping”.
