世界各国法律的相互作用和相互吸收大大促进了法律的不断发展和完善。法律移植是对外来法的继受,在法律发展过程中意义重大。本文从法律史的角度总结了法律移植的发展规律,阐述分析了法律移植的范围和影响因素,提出了法律移植过程中需要注意的问题。
The interaction and mutual absorption of the laws of various countries in the world have greatly promoted the continuous development and improvement of the law. Law transplantation is the succession of foreign law, in the process of legal development of great significance. This paper summarizes the development law of legal transplantation from the perspective of legal history, expounds the scope and influencing factors of legal transplantation, and points out the problems that need attention in the process of legal transplantation.
