《企业法》明确规定:“职工代表大会是企业民主管理的基本形式,是职工行使民主管理权力的机构”。如何落实职工代表大会制度,发挥职工代表民主监督作用,既是实践江泽民同志“三个代表”的要求,也是企业实现依法治企和科学管理的有效途径。 当前,部分企业在发挥职工和职工代表大会的作用上,普遍存在力度不够、效果不好的问题,其中既有认识上的偏差,也有操作方面的问题。一是由于在实行法人治理企业过程中,过多强调了新“三会”的权威,而冲淡和忽视了职工代表大会的权威和作用,甚至有些企业领导将职工及职工代表大会的监督作用与自己的权力对立起来,那又怎能不滋生官僚主义、长官意识乃至腐败呢。二是有些单位在产生职工代表时,不能严格按程序和条件进行民主评选,而是将此当作一种荣誉

At present, some enterprises have the problem of insufficient strength and poor effectiveness in the role of employees and workers’ representatives. There are both cognitive biases and operational problems. First, due to the excessive emphasis on the authority of the new “Three Conferences” in the process of administering corporate governance by legal persons, it has diluted and neglected the authority and role of the workers’ congress, and even some corporate leaders have supervised the role of the workers’ and workers’ congresses. If one’s own powers are opposed to one another, how can it not breed bureaucracy, chief executive consciousness, or even corruption? Second, when some units produce employee representatives, they cannot perform democratic selection strictly in accordance with procedures and conditions, but use this as an honor.
