行政决策系抽象行政行为,当前我国决策听证的主要问题在于听证结果对于最终决策没有明确其法律拘束力,故其与具体行政行为的听证制度相比在听证目的、发动主体和条件、组织和参与者、听证记录和结果效力等方面存在瑕疵。完善我国行政决策听证效力,一是行决策听证的效力保障;二是完善决策听证的效力责任。
