法院审查大学行政行为时,既应尊重大学决策的自主性,又应保障大学生等相关人权利,而确立有限学术遵从的立场。这要求法院在对涉案大学行为进行合法性审查时遵循法律解释的一般方法,并在学术规律的约束下展开解释。对于涉案事务是否属于学术事务而需遵循学术规律,法院可从该事务的固有价值与功利价值予以论证,并对大学学术判断给予较大程度遵从。在合理性审查中,则应以比例原则尤其是必要性原则为标准衡量涉案大学学术利益与大学生等相关人权利,建立有条件的优先关系。核心技术即审查大学是否严肃且善意地考虑了可行的替代性措施;审查该大学行为是否遵循了以专业竞争力为基础的同行评审要求。对此,大学不能获得司法遵从。
When examining university administrative behavior, the court should respect the autonomy of university decision-making, and protect the rights of college students and other related persons, and establish a limited academic compliance position. This requires the court to follow the general method of legal interpretation when conducting legality examination of the behavior of the university involved and explain it under the academic rules. As to whether a case involved in a case is a matter of academic nature, academic rules must be abided by. The court can argue from the intrinsic value and utilitarian value of the matter and give a greater degree of compliance with the academic judgment of the university. In the rationality examination, the principle of proportionality, especially the necessity, should be used as the standard to measure the academic interest of the university involved and the rights of relatives, such as college students, and to establish conditional priority relationships. The core technique is to examine whether the university has taken a viable and substitute measure seriously and in good faith; examines whether the university’s conduct follows the peer review requirements based on professional competence. In this regard, universities can not obtain judicial compliance.
