公正司法,就是指要在司法的过程和结果中体现公正与正义的原则。从近年来我们对司法机关的执法情况看,当前司法不公的问题比较突出,一方面影响了司法机关、司法人员的形象,一方面更使司法的社会公信力受到严重影响。要解决司法不公的问题,必须认真探究导致司法不公正的根源。笔者认为,从宏观上看,原因是多方面的,有政治的、经济的,也有文化的、历史的、现实的。具体地说主要有以下几方面的表现和原因。
Just justice refers to the principle that fairness and justice should be reflected in the judicial process and its result. Judging from the law enforcement situation of the judiciary in recent years, the current issue of unfair administration of justice is rather prominent. On the one hand, it has affected the image of judicial organs and judicial personnel, and on the other hand, it has severely affected the social credibility of the judiciary. To solve the problem of judicial injustice, the root causes of judicial injustice must be carefully explored. The author believes that from a macro point of view, the reasons are many, political, economic, but also cultural, historical, realistic. Specifically, there are the following aspects of the performance and reasons.
