澳大利亚诉日本捕鲸案是涉及《国际捕鲸管制公约》第八条“科研捕鲸”例外的第一起案件,国际法院最终判决日本因不符合《国际捕鲸管制公约》第八条的规定而败诉。国际法院在该案的判决中对某些争论焦点采取了回避态度,未能根本解决国际社会对鲸的保护态度的对立。国际捕鲸委员会要真正实现对鲸的保护和对捕鲸行为的国际管制还需要解决自身的许多问题。
Australia v. Japan whaling case is the first case concerning the exception of Article 8 of the International Convention on Cohabiter Control and “Scientific research whaling”. The International Court of Justice eventually ruled that Japan was not in conformity with Article 8 of the International Convention for the Regulation of Whale Provisions and lost. In its judgment, the International Court of Justice has taken some evasive attitudes towards some of the arguments in dispute and failed to fundamentally resolve the international community’s opposition to whale protection. The International Whaling Commission needs to address many of its own problems in order to truly protect whales and regulate international whaling.
