房屋连环买卖中的物权变动探析

内容提要房屋连环买卖作为典型的不动产连环交易,在司法实践中呈现出各交易主体基于不同诉因起诉的案件类型,由于物权立法缺失,理论界学说纷呈,实务界裁判各异。如何在司法实务中正确处理此类纠纷,一直是困扰民事审判的一大难题。本文以物权法的颁布为契机,通过物权法重点法条的立法解读,梳理物权基本理论,运用请求权基础分析方法,在房屋连环买卖实例分析中探讨了物权变动与合同效力、无权处分、善意取得、占有保护的相关法律疑难问题,并就未来物权法司法解释的制订提供若干建议,力图为在物权法制度框架下解决实务纠纷提供具体的裁判规则和有效的思维方法。 As a typical chain of real estate transactions, housing chain trading presents the types of cases that various trading entities sue on the basis of different cause of action. Due to the lack of real right legislation, there are many theories and theories in real estate sector and different judgments in practice. How to properly handle such disputes in judicial practice has always been a major problem plaguing civil trials. This article takes the promulgation of Real Right Law as an opportunity, through the legal interpretation of the key articles of Real Right Law, combing the basic theory of real right and applying the basic analysis method of claim, discusses the change of real right and the validity of the contract, Goodwill acquisition and possession protection, and provide some suggestions on the future judicial interpretation of property law, trying hard to provide specific rules of judgment and effective thinking for solving practical disputes under the real right law system.
