告知程序是行政处罚的必经程序。在实现行政公正、公平、民主,维护行政秩序,以及保护公民的合法权益方面,告知程序发挥着重要作用。但是,在我国行政处罚中关于告知程序的相关规定还不够成熟,在诸如告知形式、告知发生的时间和告知期限、告知对象与内容等方面还存在许多缺陷,需要我们在法治进程中不断加以完善。
To inform the procedure is the necessary procedure for administrative punishment. The process of informing plays an important role in achieving administrative justice, fairness, democracy, maintaining administrative order and protecting the legitimate rights and interests of citizens. However, the relevant provisions on the procedure of notification in China’s administrative punishment are not yet mature enough. There are still some shortcomings in terms of the form of notification, the time of notification, the time limit of the notification, the object of disclosure and the content, etc., which need us to continuously improve in the course of the rule of law .
