在当今世界经济快速发展的过程中,情势变更原则作为民法上的一项重要制度,其使用具有十分重要的意义。然而,在我国的合同法领域,却长期缺失该项制度。2007年8月至2008年8月,国内建筑材料价格暴涨,建设工程以固定价方式结算的合同在履行过程中出现了困境与难题。学界中对于情势变更原则在建设工程合同中是否应使用、如何适用等问题,均存在较大分歧。因此,深入探讨情势变更原则应如何在建设工程合同中适用,具有十分重要的现实意义。
In the process of rapid economic development in the world today, the principle of changing circumstances is an important system in civil law and its use is of great significance. However, in the field of contract law in our country, the system is missing for a long time. August 2007 to August 2008, the domestic construction materials prices soared, the construction project settled in a fixed price contract in the course of the performance of the difficulties and problems. In the academic circles, there are some big differences in the application of the principle of situation change in construction contracts and how to apply them. Therefore, it is very important and practical to study how the principle of change of circumstances should be applied in the construction contract.
