党的十八届四中全会决议强调,“法律是治国之重器,良法是善治之前提”。“良法”是指能够体现大多数人的意志和利益,符合社会发展内在规律要求、促进社会发展进步、保障公民权利而同时又在形式上完善的法律制度。新形势下,军事法的良法标准主要体现在:为实现强军目标提供法制保障,实现权力制约与军人权益保障的高度契合,体现了科学立法与民主立法的统一。
The resolution of the Fourth Plenary Session of the 18th CPC Central Committee emphasized that “law is the weight of governing the country and good law is the prerequisite for good governance.” “Good Law” refers to a legal system that reflects the will and interests of most people, meets the inherent laws and requirements of social development, promotes social development and progress, and protects citizens’ rights at the same time. Under the new situation, the standards of good laws in military law are mainly manifested in providing legal guarantee for achieving the goal of strengthening the armed forces and achieving a high degree of conformity between the power restriction and the guarantee of the rights and interests of military personnel, which reflects the unification of scientific legislation and democratic legislation.
