国际刑事法院在管辖权问题上向来备受各国关注。补充性原则是管辖权方面的一项重要制度,用于处理国际刑事法院与国家法院管辖权冲突问题。补充性原则确立了国际刑事法院管辖权的属性,确保了国家法院对国际罪行优先管辖的地位,国际刑事法院只有在国家不能够或不愿意行使管辖权时,才取得管辖权。如何适用补充性原则成为处理好国际刑事法院与国内法院管辖权冲突的关键。
The International Criminal Court has always drawn the attention of all countries on the issue of jurisdiction. The principle of complementarity is an important system of jurisdiction that deals with the conflict of jurisdiction between the International Criminal Court and the national courts. The principle of complementarity established the attributes of ICC jurisdiction and ensured the primacy of State courts in the jurisdiction of international crimes. ICC took jurisdiction only when the State was unable or unwilling to exercise jurisdiction. How to apply the principle of complementarity has become the key to handling the conflicts of jurisdiction between the ICC and domestic courts.
