随着我国社会经济的不断发展,民事诉讼纠纷也呈现出复杂化、专业化的趋势,2015年最高院出台的新民事诉讼司法解释再一次规范了专家辅助人制度的适用标准。但我国专家辅助人制度在当下仍有许多不完善之处,尤其是专家辅助人制度的诉讼地位问题存在着较大的争议,这直接会导致该制度在司法实践中难以适用。专家辅助人诉讼地位问题的解决依赖于对该制度在理论上的充分探讨与分析,从而厘清争议,完善专家辅助人制度。
With the continuous development of social economy in our country, civil litigation disputes also show the trend of complication and specialization. In 2015, the judicial interpretation of new civil procedure promulgated by the Supreme People’s Court once again standardized the applicable standards of the expert auxiliary system. However, there are still many imperfections in the system of expert assistants in our country. Especially, there is a big controversy over the litigation status of expert supporter system, which will directly lead to the difficulty of applying the system in judicial practice. The solution of expert auxiliary legal status relies on the full exploration and analysis of the system in theory so as to clarify disputes and improve the system of expert assistants.
