认为业内人士20多年来为制定图书馆法所做的诸多努力中,存在着立法策略的偏差:一是地方立法动作缓慢、数量少,对现行地方立法的现实作用和经验总结不够,可供国家制定统一图书馆法的经验不足;二是社会参与不够,特别是司法实践部门对立法的需求不迫切。指出进一步推动图书馆立法的策略:一是加强地方立法,循序渐进推动国家立法;二是图书馆实践与司法实践相结合,以司法需要推动国家立法。
The author believes that there are some deviations in the legislative strategies in the efforts made by the people in the industry over the past two decades in the drafting of the Library Law. First, local legislation has been slow and has a small number. The actual role and experience of the current local legislation are not summarized enough for the country The lack of experience in formulating a unified library law; second, inadequate social participation, especially the need of judicial practice departments for legislation. It points out the tactics to further promote library legislation: First, to strengthen local legislation and step by step to promote national legislation; Second, the combination of library practice and judicial practice, with the judicial need to promote national legislation.
