根据上海市卫生局卫生监督所对违法医疗广告检查和监测,2007年开始实施《医疗广告管理办法》后,违法发布医疗广告数量明显下降。但新出现许多变相违法医疗广告,医疗广告的界定仍较模糊,处罚依据不明,适用法律混乱,应依据《办法》,出台细则,加强社会监督。
According to the inspection and monitoring of illegal medical advertisements by the Health Supervision Office of Shanghai Municipal Health Bureau, after the implementation of the “Medical Advertising Administration Measures” in 2007, the number of medical advertisements released illegally dropped significantly. However, there are many new illegal medical advertisements in disguised form. The definition of medical advertisements is still vague. The basis for the punishment is unclear. The applicable laws are confused. Rules and regulations should be promulgated to strengthen social supervision.
