在构建完善中国特色军事法治体系的背景下,编纂军事法典不仅暗含了提高军事立法技术、完善军事法规制度体系的价值,更具有增进军事法实施、提高军事法部门法地位等价值。在全面梳理军事法规制度建设成就和问题基础上,加强编纂军事法典的理论研究,并以统一军事法典为目标指引军事立法实践,对于构建完善中国特色军事法治体系、促进中国军事法的发展具有重要意义。
Under the background of building and perfecting the military rule of law system with Chinese characteristics, codifying the military code not only implies improving the technology of military legislation, improving the value of the system of military laws and regulations, but also enhancing the implementation of military law and raising the status of military law and other branches of law. On the basis of comprehensively combing the achievements and problems in the construction of military laws and regulations, strengthening the theoretical study of compiling the military code and guiding the military legislative practice with the goal of unifying the military code are of great importance in establishing and perfecting the military legal system with Chinese characteristics and promoting the development of China’s military law significance.
