2014年3月11日,中国人民银行下发《支付机构网络支付业务管理办法》征求意见稿,如一石激起千层浪,在第三方支付行业内引起众声喧哗。业界人士认为,该征求意见稿所反映出的监管思路一旦落实,将极大地挤压第三方支付企业的生存空间;人民银行则认为自己是为了保证第三方支付安全。~①但真理究竟掌握在哪一方手中,并非简单的网络口水战可以决定。本文认为,对第三方支付监管不能用简单的“是”或者“否”笼
On March 11, 2014, the People’s Bank of China issued a draft for soliciting opinions on the Measures for the Administration of Payment Business Network Payment Services. As a result of a wave of rippling waves, it caused a loud noise in the third-party payment industry. The industry believes that once the regulatory thinking reflected in the draft has been implemented, it will greatly squeeze the living space of third-party payment companies; the People’s Bank of China considers itself to ensure the third-party payment security. However, it is not a simple cyberwar war that can be decided. This paper argues that the regulation of third-party payment can not be used with a simple “yes” or “no” cage
