自然人死亡后,在财产关系方面有两个问题须处理,一是该人的遗产继承问题,二是该人生前所欠债务问题。继承人放弃继承能否作为债权人行使撤销权的对象呢?对此问题,《中华人民共和国继承法》第46条规定:“继承人因放弃继承权,致使其不能履行法定义务的,放弃继承权的行为无效。”那么此条法律规定能否完全合理地解决“继承权放弃能否为撤销制度之标的”的问题呢?
After the death of a natural person, there are two issues that must be dealt with in relation to property, one is the inheritance of the person’s inheritance and the other is the debt owed to the person before his death.
