法治社会不仅是指依法治理、依法而治的社会,而且是社会层面的法治建设。法治社会是基于对人情社会以及国家权力局限性的深刻反思。通过一种自发秩序和公民参与社会管理的发展路径,逐步培育公民的权利意识、参与热情,从而与国家一道形成一种共治秩序。在法治社会目标指引下,法律由国家统治社会的工具变为保护社会的工具和社会自我保护的工具;由作为国家单向控制社会的工具。转到法成为国家与社会双重与双向控制的工具;由逐步实现法治国家。到最终形成法治社会。
A society ruled by law not only refers to a society that is governed by law and is ruled by law, but also a building of the rule of law at the social level. The society ruled by law is based on profound reflection on the social situation of human beings and on the limitations of state power. Through a spontaneous order and citizens’ participation in the development of social management, they gradually cultivate their awareness of their rights and participate in their enthusiasm, so as to form a common governance order with the country.
