从1995年以来,已有75件全国人大议案建议修改环保法,若加上政协委员、专家学者和基层干部提出的建议,数量更多。对同一个议题有这么多议案和建议反复提出,比较罕见,说明修改环保法有很强的现实需要。目前修改《环保法》的工作已经启动,修改草案已经提交全国人大常委会,不久将予以审议。修改环保法,关系到环境保护的基本架构和总体布局,兹事体大,引起了立法、司法、执法、管理、社会、学术等各界人士的高度关注和重视。在这种情况下,深入思考和讨论修改环保法中的理论和现实问题,是有意义的。
Since 1995, 75 NPC resolutions have proposed to amend the environmental protection law. If we add the suggestions made by CPPCC members, experts, scholars and grassroots cadres, there will be more. There are so many motions and suggestions on the same subject that they are repeatedly put forth and are relatively rare. This shows that there is a strong practical need to amend the Environmental Protection Law. The current revision of the “Environmental Protection Law” has started. The draft amendment has been submitted to the NPC Standing Committee and will be reviewed shortly. Revising the Environmental Protection Law has a bearing on the basic framework and overall layout of environmental protection. The large number of things has caused great concern and attention from legislators, the judiciary, law enforcement, management, society and academia. Under such circumstances, it is significant to think deeply and discuss the revision of the theoretical and practical issues in the Environmental Protection Law.
