跨界污染治理有别于在特定行政区划内实施的环境污染治理,它必须以各地方政府及其部门之间的通力合作为前提。从中国跨界污染治理的实践来看,行政协助能够为地方政府及其部门的合作提供必要的制度支撑,但它也存在较为明显的失范问题。为此,必须从跨界污染治理中行政协助的基本原则、主体范围、适用条件、实施程序、责任承担五个方面着手,实现跨界污染治理中行政协助的制度构建,以全面推进中国跨界污染治理的实施进程。
Cross-border pollution control is different from the implementation of environmental pollution control within a specific administrative divisions, and it must be premised on the concerted efforts of all local governments and their departments. From the perspective of the practice of cross-border pollution control in China, administrative assistance can provide the necessary institutional support for the cooperation between local governments and their departments, but it also has the obvious problem of anomie.
