在安全生产领域中行政监督人员的监督过失往往被以玩忽职守追究刑事责任,但在其行为与最终危害结果因果关系之间所呈现的“间接性”使得因果关系的认定出现混乱状态。对此,应当以“三阶判断”考察不作为行为与最终危害结果之间的因果关系,限制刑法的扩张适用。在第一层次中,通过对作为义务的考察,确定职权的主次关系,对于次要义务在一定程度上免除行为人的注意义务。在第二层次中,通过对具体检查业务要求与危害结果之间因果关系的构建,对于具体业务中未规定之要求,不能构建起行为与危害结果之间的因果关系;在第三层次中,在纵向层面对于负有安全检查职责的国家机关工作人员中“直接负责的主管人员”的职权行使情况进行实质性考察,以明确该罪主体适用范围。
