以黑格尔为主要完成者的近代法哲学本质上是法的形而上学。马克思的法哲学本质上是法哲学批判或法的形而上学批判。马克思的法哲学批判理论同时划清了两条界限 ,即一方面划清了与近代法哲学之间的原则界限 ,另一方面也划清了与各种空想社会主义之间的原则界限 ,从而对现代法权保持了一种否定与肯定、批判性与建设性相统一的辩证立场。正确把握马克思法哲学批判理论中的两条界限 ,认清现代法权的本质并对其采取辩证态度 ,对于我国正在进行的社会主义政治文明建设具有重大的现实意义
