本文所考察的问题是在可能殃及无辜乘客时是否仍然可以对被劫飞机采取武力行动。文章虽是以德国联邦宪法法院新近做出的裁决为起点,但其却对相关问题从伦理学、刑法学、宪法学和政治学的角度进行了颇为全面的论述。作者认为,公民个人针对被劫飞机采取的致命武力行为构成违法,但应当免除责任。然而当政府官员采取行动以保护其他公民生命的时候,保护权(protective rights)便与防卫权(defensive rights)产生冲突。但此种冲突不能在有关权利比较的语境下得到解决,因而选择救助更多数人的生命是合法的、正当的。
The issue examined in this paper is whether military action on the victimized aircraft can still be taken while possible innocent passengers may be affected. Although the article starts with the ruling recently made by the Federal Constitutional Court of Germany, it does a fairly comprehensive discussion of relevant issues from the perspectives of ethics, criminal law, constitutional law and political science. The author believes that individual citizens committed the deadly force against the robbed aircraft constitutes an offense, but should be exempt from responsibility. However, when government officials act to protect the lives of other citizens, protective rights conflict with defensive rights. However, such conflicts can not be resolved in the context of comparative rights. Therefore, it is legal and justified to choose to rescue more people’s lives.
