党的十五大报告明确指出:“依法治国,是党领导人民治理国家的基本方略,是发展社会主义市场经济的客观需要,是社会文明进步的重要标志,是国家长治久安的重要保障。”一个城市如何有效地贯彻落实依法治国方针,推进依法治市,首要的是要对其实施领导的主体进行定位。目前,有的认为实施依法治市的领导主体是各级人大,有的认为应是各级政府,有的则认为应是城市各执法机关等。我们认为,领导实施依法治市的主体应该是地方党委。
The report of the 15th National Congress of the CPC clearly states: “Governing the country according to law is the basic strategy the party leads the people in administering the country, an objective requirement for developing a socialist market economy, an important symbol of the progress of social civilization and an important guarantee for the country’s lasting peace and stability.” How to effectively carry out the principle of governing the country according to law and how to govern the market according to law is the most important task for the city to locate the main part of its implementation. At present, some people think that the main body responsible for the implementation of the principle of governing the city by law is the NPC at all levels, some think it should be all levels of government, and others think it should be the city’s law enforcement agencies. In our opinion, the main body that leads the implementation of the law-based market regulation should be the local party committees.
