伴随着我们国家社会经济不断高速的发展,网络技术普及率也日益增高,许多新生事物也随之产生。当前,网络游戏是社会网民在从事网络活动当中主要的行为之一,网络虚拟财产也随着网络游戏不断的发展而出现。网络虚拟财产是一种比较新型的财产形式,其主要是存在网络空间当中,网络虚拟财产具有多种特征例如:数字化、虚拟形态。网络虚拟财的种类也包含很多种,主要包含游戏货币、游戏装备、电子邮箱账号、游戏账号、邮箱账号、账号里面的内容等等。本文首先对当前网络虚拟财产的法律保护现状进行了阐述,其次本文从具体案例作为切入点对当前网络虚拟财产的刑法保护进行分析,最后本文针对我们国家网络虚拟财产的刑法保护提出一些建议。
With the continuous rapid social and economic development in our country, the popularization rate of network technology is also increasing day by day. Many new things have also emerged. At present, online games are one of the main behaviors of social netizens engaged in network activities. Network virtual property also appears along with the continuous development of online games. Network virtual property is a relatively new type of property, which mainly exists in cyberspace. Network virtual property has many features such as digitalization and virtual form. There are many kinds of network virtual money, including game currency, game equipment, email account, game account, email account, account number and so on. This article first elaborates the legal protection status quo of the current network virtual property. Secondly, this article analyzes the criminal law protection of the current network virtual property from the specific case as an entry point. Finally, this article puts forward some suggestions for the protection of the criminal law of our national network virtual property.
