宽严相济刑事政策是我国构建社会主义和谐社会的背景下提出的基本刑事政策,罪刑法定原则是我国刑法的基本原则之一,二者有共同的理念基础和价值目标,宽严相济刑事政策应当受到罪刑法定原则的制约,同时对罪刑法定原则的确立具有补充和引导作用,实现二者有机统一对维护社会公平正义、构建和谐社会具有重要意义。
