文章认为,图书馆通过镜像提供数据库资源不仅仅是技术自动安排的结果,深度链接也不是侵权的直接依据,需要根据信息网络传播权权利内容分析具体行为并结合行为人的主观状态来认定是否侵权。
The article holds that the library provides the database resources through mirroring not only as a result of the automatic arrangement of technology, but also that the deep linking is not the direct basis of infringement. According to the information dissemination right of content, the content analysis should be conducted according to the concrete behavior and the perpetrator’s subjective state to determine whether the infringement .
