人民监督员制度在全国的实践已初显成效。不过,这一尚在探索中的制度还有诸多的问题需要从法理上予以解答。其中,人民监督员监督意见的效力问题就是一个需要探讨回答的重要问题。人民监督员的监督有无效力?人民监督员依据一定的程序进行监督并形成了监督意见,倘若这一意见与检察机关的意见相左,检察机关是否必须按人民监督员的意见办?笔者试就人民监督员监督意见的效力问题作一探讨。
