将征收的不动产用于商业开发并非一律违宪。商业利益并非一定与公共利益相冲突,公共利益经常与商业利益混杂在一起。公共利益有多种实现机制,通过公共权力部门实现公共利益只是其中的一种方式。不动产征收中的“公共利益”认定标准可以通过司法实践来逐步完善。
