危险驾驶罪是《刑法修正案(八)》新增的一个罪名。该修正案实施以来在社会上取得了很好的效应,但也折射出一些问题。本文结合《刑法修正案(八)》的实施,以醉酒驾驶为切入点,对危险驾驶罪的理解及应用过程中存在的问题进行探究,以期能够更好地指导司法实践。 Dangerous driving offense is a new offense under Criminal Law Amendment (8). Since the implementation of the amendment, it has achieved very good social effects, but it also reflects some problems. Combining with the implementation of “Criminal Law Amendment (8)”, this article takes drunk driving as the starting point, explores the problems in the understanding and application of dangerous driving offense in order to better guide the judicial practice.
