鲁道夫·耶林(1818~1892),与萨维尼(1779~1861)和祁克(1841~1921)并列。是19世纪西欧最伟大的法学家,也是新功利主义(目的)法学派的创始人。其思想不仅对西欧,而且对全世界都发生了巨大的影响。本文拟对耶林的法哲学理论作些评述。 耶林的主要作品有《罗马法的精神》(全四册,1852~1863)、《为权利而斗争》(1812)、《法的目的》(全2卷,1877~1884)。他的法哲学理论的内核,也集中在这三本书中。
Rudolf Jelling (1818-1892), tied with Savigny (1779-1861) and Qike (1841-1921). Is the greatest jurist in Western Europe in the nineteenth century and the founder of the new utilitarian (purpose) school of law. Its thinking has had a huge impact not only on Western Europe but also on the entire world. This article intends to make some comments on Jhering’s theory of legal philosophy. Jelling’s main works are “The Spirit of Roman Law” (four volumes, 1852-1863), “Fighting for rights” (1812), “The Purpose of Law” (2 volumes, 1877-1884). The core of his jurisprudence theory is also concentrated in these three books.
