信访制度是富有中国特色的表达民意的窗口,是我国一项特殊的民主政治制度,兼有权利救济的功能,作为我国一项重要的政治法律制度,信访制度在发挥积极作用的同时也伴随着产生了许多现实问题。本文旨在通过分析信访制度存在的问题,以及借鉴欧洲的监察员制度和其他请愿制度,探索解决信访问题的有效途径,从信访权作为基本人权的地位出发实现信访制度的完善和法制化,这在当今推动我国依法治国、构建和谐社会具有重要意义。
As a special political and legal system in our country, petition system is a special democratic political system with Chinese characteristics and a special democratic political system with the function of right and remedy. The petition system plays an active role as well as Produced many realistic problems. The purpose of this paper is to find out the effective ways to solve the problem of letters and visits by analyzing the problems existing in the system of letters and visits, and drawing on the system of inspectors and other petitions in Europe. To improve and legalize the system of letters and visits from the standpoint of the right to petition as a basic human right It is of great significance to promote China’s rule of law and building a harmonious society in our country today.
